An arbitration provision in an employment agreement couldn't be enforced against an employee's beneficiaries bringing a wrongful death suit, the Ohio Supreme Court has ruled.

The plaintiffs were the beneficiaries of a steel worker who signed an employment agreement which included a provision that arbitration would be his exclusive remedy for any claims he might have. The agreement's terms stated it also applied to his beneficiaries. After he fell to his death at work, his widow filed a wrongful death action on behalf of his beneficiaries.
