An arbitration provision in an employment agreement couldn't be enforced against an employee's beneficiaries bringing a wrongful death suit, the Ohio Supreme Court has ruled.
The plaintiffs were the beneficiaries of a steel worker who signed an employment agreement which included a provision that arbitration would be his exclusive remedy for any claims he might have. The agreement's terms stated it also applied to his beneficiaries.
