A medical malpractice claim alleging that a hospital's radiology department failed to detect a brain tumor was time-barred, even though the plaintiff obtained further treatment from the department within the limitations period, the Connecticut Supreme Court has ruled in affirming a summary judgment.

The plaintiff's doctor sent her to the hospital for an MRI after she complained of persistent headaches. A radiologist at the hospital failed to detect the early signs of a brain tumor. The plaintiff's headaches did not abate, and more than three years later she returned to the hospital for a second MRI. Another radiologist looked at the second MRI and discovered the tumor.
