Maine Supreme Judicial Court Says Mandatory Blood Testing Allowed in Fatal Accidents

A state statute that mandates blood alcohol testing of drivers in motor vehicle accidents where people are killed or may die and allows admission of the test results in a criminal trial of the driver doesn't violate the Fourth Amendment, Maine's highest court has ruled.

The defendant was driving a car that was involved in a head-on collision. Two occupants of the other vehicle died. The police didn't smell alcohol on the defendant or cite any other reason to believe he was under the influence.
