A state statute that mandates blood alcohol testing of drivers in motor vehicle accidents where people are killed or may die and allows admission of the test results in a criminal trial of the driver doesn't violate the Fourth Amendment, Maine's highest court has ruled.
The defendant was driving a car that was involved in a head-on collision. Two occupants of the other vehicle died. The police didn't smell alcohol on the defendant or cite any other reason to believe he was under the influence.See the full content of this document
