Resolving a contentious issue, the New Jersey Supreme Court has adopted a rule change allowing lawyers to advertise themselves as "Super Lawyers" and/or "Best Lawyers in America."

In 2006, the state's Committee on Advertising issued Opinion 39, which ruled that lawyers who touted themselves as a "Best Lawyer in America" or a "Super Lawyer" were engaging in a form of unethical comparative advertising, creating unlikely expectations in consumers.
