A husband who intended to annoy his ex-wife by signing her up for explicit websites and ordering adult magazines and books to be delivered to her house engaged in conduct intended to "harm" her for purposes of identity theft, the Wisconsin Court of Appeals has ruled in upholding his conviction.
The identity theft statute criminalized conduct intended to "harm the reputation, property, person or estate" of another.
