'Intended' Parent Can Enforce Gestational Contract, Rules Connecticut Supreme Court

Summary


An intended parent under a gestational contract can become the legal parent of children conceived through artificial insemination - even though he is not a biological parent, the Connecticut Supreme Court has ruled in affirming judgment.

The plaintiff and his same-sex domestic partner entered into a written agreement with the defendant. Under the agreement, the defendant agreed to carry to term eggs from a third-party donor fertilized by sperm provided by the plaintiff's partner. The contract also provided that the plaintiff and his partner were to become the child's parents with the defendant agreeing to terminate her parental rights.
