Employment Discrimination Plaintiffs Do Poorly in Federal Court, Study Says

In December 2008, Harvard Law and Policy Review, the official journal of the American Constitution Society for Law and Policy (ACSLP) will publish a study showing that federal courts disfavor employment discrimination cases, and that plaintiffs with employment discrimination claims are "forswearing" federal court. The authors also found that employment discrimination cases fare much worse than other kinds of cases. Whatever the reason for the decline in discrimination case filings, the authors said the apparent bias against discrimination plaintiffs was "troublesome." In a September press release, the ACSLP announced that the study's findings would be presented at a hearing to the Senate Judiciary Committee.
