1st Circuit Court Rules Shareholders May Be 'Employees' Under Ada

Summary


Shareholders-directors of a close corporation may be considered "employees" for the purposes of determining whether the company meets the ADA's 15-employee requirement, the 1st Circuit has ruled in reversing a summary judgment.

The plaintiff sued her employer for pregnancy discrimination and hostile work environment, but the company filed for summary judgment, claiming that it had fewer than 15 employees.
