In a rare move, the 8th U.S. Circuit Court of Appeals has retracted a footnote in an opinion that attributed statements to an attorney that the attorney said he never made.
The court reissued an opinion this morning in U.S. and State of Missouri v. Metropolitan St. Louis Sewer District, in which the appeals court said the state waived its right to sovereign immunity by participating as an active plaintiff in a federal environmental lawsuit against the Metropolitan St. Louis Sewer District. The decision meant that the district can sue the state to try to force it to cover any judgment under the environmental suit, which claims that the district violated the Clean Water Act.See the full content of this document
