Police were required to warn a child pornography suspect of his Miranda rights before questioning him in conjunction with a search of his home, the 1st Circuit has ruled.
The defendant was a member of the military. His commander ordered him to return home to meet police who had obtained a search warrant after the discovery of child pornography on a used computer the defendant had sold. Police questioned the defendant for approximately 50 minutes in and outside his home. During the questioning, the defendant admitted to downloading the images.See the full content of this document
