A cellular telephone company may enforce an arbitration clause in its customer service agreement after it was sued for improper billing in violation of the Federal Communications Act, the 9th Circuit has ruled.

The plaintiff filed a class action against AT&T Wireless, alleging that the company violated the Act by employing "out-of- cycle" billing for its cellular services. According to the plaintiff, AT&T customers incurred improper charges because of the company's practice of billing for cellular calls during a billing period other than the period in which the calls were made.
