This August the Canadian Bar Association Council will debate a new professional code of conduct that encourage attorneys to inform their clients about different ADR options. In addition, the proposed code outlines new ethical considerations for lawyers who serve as mediators. To encourage greater use of ADR, the proposed code calls for lawyers to "consider the use of ADR tor every dispute" and, "if appropriate," inform their clients of ADR options.
