California Court of Appeal Says Expert Can't Testify On Dui Test's Margin of Error

A drunk driving defendant could not introduce expert testimony on the margin of error in the results from the breath testing machine used by law enforcement, the California Court of Appeal has ruled in reinstating a driver's license suspension.

The state suspended the defendant's license after he registered a blood alcohol content (BAC) of .09 and .08 percent in two breath test administered during a traffic stop. The state's legal limit is .08 percent.
