Background checks for job candidates can present difficult choices for employers when the checks reveal unfavorable issues. Contact a risk management adviser to discuss your options and any exposure the firm may face as a result of your actions. A few of the issues involved in an employer's options include:

* Local, state and federal laws can be difficult to interpret as they relate to background checks for job candidates. Make sure that the information gathered truly relates to the duties of the position. Any adverse employment decision based on information found during a background check must be disclosed to the applicant.

* Does the firm's employment offer include language indicating that the offer is contingent based on the results of a background check? Are background checks done before an employee begins work?
